The Difference Between a Wrongful Death Claim and a Survival Action
Following the death of a loved one, a family can easily be devastated under the weight of financial insecurity. Many homes in New York require each family member to work full-time jobs to make rent, pay for household expenses, and raise children. The resulting financial fallout of a death can completely change the course of an entire family.
How to File a Personal Injury Claim as an Undocumented Immigrant
Built on the strength and culture of immigrants, New York City is one of the most diverse cities in the world. As such, it is home to hundreds of thousands of undocumented workers who provide much-needed services throughout the city. Unfortunately, when injured, they often are afraid to come forward to seek medical treatment, much less to file a claim for damages against a negligent or reckless person.
Calculating Long-Term Damages in a Claim
A serious auto accident, slip and fall, or construction site injury can easily put you out of work for weeks or months. You will need to take time off to recover from your injury, attend doctor’s appointments and surgeries, and attend physical therapy sessions. That is not discounting the possibility that you develop a disability due to your accident, which can add months to your recovering time, and you may still be left with a serious health condition afterward. All of this is to say that the cost of your injury goes far beyond your physical injuries. However, if someone else is at fault for your injuries, then you may be able to recover both lost wages and lost future earnings in a personal injury claim.
Going Silent on Social Media After an Accident
Social media is an excellent networking tool and a great way to stay in touch with friends and family. Platforms such as Facebook, LinkedIn, Instagram, and Twitter are in constant use by people of all ages, and TikTok has all but overtaken Snapchat among younger users. Most adults are also so accustomed to using these platforms that checking in and posting updates is part of their daily routine. Social media has definite advantages for many people, but take care how you use it if you are filing a personal injury claim.
The Dangers of an Electrical Injury
Though we often do not realize it in New York, power lines run throughout our city in an underground series of wires. This utility system supplies power to everything in our daily lives, from our apartment’s appliances to major construction sites to even our cars now. With so much energy around us, it is almost inevitable that someone can become injured due to an electric shock, but oftentimes it is the fault of a negligent property owner, dangerous product, or poor building planning.
How the Eggshell Skull Rule Effects PI Claims
Whether you were in a vehicle collision or construction accident, you are likely dealing with a great deal of pain, both physical and mental. It is not uncommon for a traumatic event to lead to a serious mental illness such as severe anxiety or post-traumatic stress disorder (PTSD). If you had a mental illness prior to an accident, your condition may in fact worsen because of the event and as a result of your physical injuries.
Prepping for Blizzards and Extremely Cold Weather
New Yorkers are a tough bunch, and know how to deal with the heat and humidity of summer, along with the freezing temperatures that hit in the winter months. While extremes in weather are a normal occurrence in the city, blizzards and extreme cold are occurring more frequently.
Helicopter Crashes into Midtown Highrise
On Monday, June 10th, a helicopter crashed on the roof of a Midtown Manhattan office high-rise at 1:43 p.m. Only the pilot was aboard the helicopter when it came down on top of 787 Seventh Ave, a 51-story building located between West 51st and West 52nd streets, at the north end of Times Square.
The incident, close to the Rockefeller Center, sent emergency response vehicles swarming to the building and immediately evoked memories of the 9/11 attacks for many concerned New Yorkers.
Could a Silent Killer Be in Your Home?
Carbon monoxide (CO) is odorless, colorless, and essentially undetectable by people and animals. You probably encounter small amounts every day, yet in large quantities, it can make you sick or kill you in a short time.
Fortunately, the use of carbon monoxide detectors can help you avoid carbon monoxide poisoning, and they are legally required in all private dwellings in New York. If a landlord fails to provide and maintain a CO detector for renters, that can make him or her liable for illness that occurs as a result of carbon monoxide poisoning. Similarly, a failure to maintain gas appliances can also make a landlord liable for illness. If you suspect carbon-monoxide-related illness, call our NY personal injury lawyers right away. The sooner we investigate, the sooner we can determine the cause if your illness and see if there’s compensation available.
Is a Ferry Disaster on the Horizon?
There have been many ferry accidents over the past decade or so; the most notable and tragic being the one in 2003 that cost the lives of 11 people and injured over 100 others. After that disaster, many new regulations were put in place and the entire system was seemingly overhauled to improve passenger safety. Yet at least one captain within the industry has warned that it was not enough, and that New York ferries are another catastrophe waiting to happen.
