New York Construction Accident - Ladder Fall
WRSMH attorneys Carmine J. Goncalves and Erin K. Hurley reached an agreement for $3 million plus a significant reduction of the workers' compensation lien after filing a motion for summary judgment in favor of our client, a construction worker from Brazil. While descending a ladder, our client's foot slipped on an oily, slippery substance on the rung, causing him to fall backward to the floor. As a result of this fall, our client suffered herniated discs in his neck, herniated discs in his back (for which he underwent a one-level lumbar fusion), and SLAP tears in both shoulders (for which he had arthroscopic surgery to only his right shoulder). He also had surgery to repair a torn meniscus in his right knee; after developing a post-surgical infection, he required irrigation and debridement.
