Hurley of Wingate, Russotti, Shapiro, Moses & Halperin, LLP secured a $4 million settlement and obtained a full workers’ compensation lien waiver for a 45-year-old undocumented construction worker. While installing insulation, the plaintiff fell from an unsecured and defective ten-foot ladder. He suffered herniations to his neck and back, both requiring one-level fusion surgery, a torn meniscus necessitating arthroscopic repair, and a torn tendon in one elbow requiring surgical repair.
The parties participated in mediation while discovery in the action was ongoing. Although the case did not settle during mediation, Carmine and Erin continued negotiations with the defendants, resulting in a resolution a few weeks later.
