New York Construction Accident - Falling Object
Shortly after filing a motion for summary judgment in favor of our client, WRSMH attorneys Carmine J. Goncalves and Erin K. Hurley secured a $1.25 million settlement plus a full waiver of the workers' compensation lien for our client, a laborer from Brazil. Our client was hit by a falling sheet of plywood, which pushed him backward into an uncovered six-foot opening between structure beams. Our client's injuries included cervical disc herniations at C3-4, C4-5, and C5-6, which were conservatively treated, lumbar disc herniations at L4-5 and L5-S1 with nerve transection surgery, also known as a nerve transfer, and left shoulder rotator cuff and SLAP tears, requiring two arthroscopic surgeries.
