Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorneys Carmine Goncalves and Erin Hurley obtained a settlement agreement of $3 million dollars plus a full waiver of comp lien for a concrete worker who was seriously injured when he fell from a scaffold onto the floor below where he was stripping concrete forms for exterior walls. Summary judgment was granted on liability to our client who was working on new luxury residential towers.
Although he had been provided with a safety harness and lanyard, the lanyard was too long. Our client suffered injuries to his right shoulder, left knee, left hip, and back. He underwent arthroscopic surgery to repair tears in his right shoulder and left knee. He also underwent lumbar fusion surgery on two levels and required a second lumbar fusion revision surgery due to instrument failure.
