New York Construction Accident - Saw Injury
WRSMH attorneys Carmine J. Goncalves and Erin K. Hurley obtained a $2.75 million settlement for our client, a carpenter from Brazil. Our client was cutting wet wood with a circular saw that had a dull blade. He stopped the saw, but the blade guard was jammed open by wet sawdust. While our client was lowering the saw, the blade cut into his right thigh, which startled him. As a result, he fell backward and hit his back and head on the wood. In addition to the large traumatic laceration of his right thigh from the blade, which required emergency washout and sutures, our client also suffered a torn meniscus in his right knee that required surgery and herniated lumbar discs that required surgical nerve transection and then a lumbar laminectomy. The defendants argued that there were no complaints about the saw's blade being dull. The defendants also disputed that our client's back injuries were not caused by the accident.
