Manhattan Construction Accident - Carpenter Injury

WRSMH attorney Michael Zisser settled this labor law case for $3 million on behalf of our client, a 53-year-old union carpenter who was injured at a building in Manhattan. While he was performing work, a large window mullion fell from several feet and struck him. Attorney Michael was able to obtain summary judgment on Labor Law 240(1), though the defendants argued that the accident was not caused by their failure to provide safety devices. As a result of the accident, our client underwent arthroscopic shoulder surgery and cervical spine fusion. The defendants disputed that our client was hurt because he did not receive medical treatment for three weeks following the accident. We countered this by establishing that our client was in pain during those three weeks but simply gave himself some time, as he hoped the injuries would resolve on their own. When they did not, he promptly sought treatment.
