Delivery Man Injured in Fall on Vacant Lot
Our client, a 55 year old delivery man was injured on a vacant lot owned by an out of possession owner, but utilized by an auto repair shop to store vehicles under repair. The plaintiff claims while exiting his delivery truck he slipped on the defective lot which was unpaved and contained holes and rocks which were covered with ice. Plaintiff claimed he was directed to park on this lot by the auto repair shop to which he was making deliveries. He fell onto his right shoulder and eventually underwent arthroscopic surgery. The matter was settled by WRSMH attorney, Michael Fitzpatrick in Westchester County for $125,000.
