William Hepner, attorney with Wingate, Russotti, Shapiro, Moses & Halperin, LLP, obtained a $3.5 million settlement for his client, a member of Local 147, who fell from a poorly constructed scaffold. Our client injured his neck, back, and shoulder, and eventually had surgery to all three areas of the body. He had previously injured his lower back a few years earlier, but had been able to continue work in the construction industry.
Bill claimed that his client, who was 40 years old at the time of the accident, could not work again in the construction industry after the accident. The defendants claimed that the way the accident occurred could not have caused the plaintiff’s injuries, and they further claimed that he had training in other fields and could go back to work in a non-physical job making similar money.
