NY Construction Accident

Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorneys Ross Barbour and Konstantin Burshteyn settled a construction accident case for $3,150,000 at pre-trial mediation. The plaintiff, a union plumber, slipped and fell on a wet staircase while accessing a jobsite and injured his lower back.

The plaintiff continued working through the pain for approximately six months before eventually seeking medical treatment and undergoing emergency spinal fusion surgery. Ross and Konstantin were able to argue that despite this being a permanent staircase, it was still a gravity-related hazard, which warranted absolute liability to the premises owner under Labor Law Section 240(1).
