NY Construction Accident

Attorney Michael Zisser recently obtained a settlement of $4,400,000 for a 46-year-old union carpenter who was injured when he was struck by a falling metal beam at a construction site in Hudson Yards. As a result of the accident, plaintiff underwent extensive treatment for a head injury (which we argued constituted a traumatic brain injury), and also underwent surgery to his shoulder and neck, which defendants disputed were related to the accident. We presented significant medical evidence to contradict their defenses regarding medical causation. Michael was also able to win summary judgment pursuant to Labor Law 240(1) by demonstrating that the metal beam was not properly secured prior to falling several feet and striking him.
