Cliff Shapiro and Noah Katz, attorneys with Wingate, Russotti, Shapiro, Moses & Halperin, LLP, obtained a recovery in the amount of $1,000,000.00 on behalf of a 72-year-old client, who was involved in a motor vehicle accident. Through deposition testimony, we were able to establish that the defendant driver was negligent for making a U-turn without observing our client driving in the opposite direction. As a result of the accident, our client sustained injuries to his lower back, which required one surgery. Our client had a long history of lower back treatment, but we were able to show that his back pain was aggravated and became more severe following the motor vehicle accident, despite the defendants’ contentions that our client’s injuries were preexisting and long-standing, given his age.
