New York Construction Accident - Struck by Falling Object
WRSMH attorneys Bryce Moses and Carmine Goncalves obtained a $5,000,000 settlement on the eve of a damages-only trial for our client, a then-39-year-old union construction worker. Our client had been hit in the head by a heavy piece of construction material weighing over 200 pounds, which unexpectedly fell near the area where he was working. Paramedics removed him from the scene. This accident resulted in a multitude of injuries to his head, neck, back, and the left side of his body, leading to six surgeries, including painful neck and back fusions with hardware inserted.
After a lengthy legal battle, where the defendants claimed the plaintiff caused the object to fall on himself, attorney Carmine was able to convince the court that the plaintiff was not at fault. The court agreed and granted the plaintiff summary judgment pursuant to Labor Law 240 (1).
