WRSMH attorney Michael J. Fitzpatrick obtained a settlement of $1,250,000 for a case that was on the trial calendar in New York County. The Plaintiff was a 33-year-old restaurant worker who tripped and fell at night on a broken sidewalk outside of a building.
While conducting depositions of the defendant's witness, our office established actual notice of the defect which caused the fall. Additionally, WRSMH retained a safety expert who established numerous code violations and departures from good and accepted practice. As a result of this incident, our client underwent a shoulder arthroscopy and a level one cervical fusion.
