Premises Liability - Trip and Fall Injury - Broken Bone
Plaintiff, a 62-year-old retired clerk, tripped and fell on a raised sidewalk next to a commercial premises. The raised sidewalk abutted a tree pit planted by the defendant, the abutting commercial property owner. Plaintiff sustained a fractured elbow which required surgery and then hardware removal. The matter settled at a private mediation two months before it was to be sent out for trial in Kings County. The case was settled by Michael Fitzpatrick for $450,000.
