Ross Barbour obtained a $2,000,000 settlement for a 35-year-old union concrete worker who fell from a broken scaffold and sustained injuries to his left knee and cervical spine, which required fusion surgery. Defendants argued that Plaintiff tripped on the scaffold but didn’t actually fall from it. They also argued that Plaintiff was provided with proper fall protection. Finally, they blamed Plaintiff’s prior medical history as the basis for his current problems. Nonetheless, Ross was able to convince the defendants to not only pay $2,000,000 to compensate the plaintiff for his injuries but also to provide a waiver of most of the Workers’ Compensation lien. The case was resolved early on in discovery and prior to being placed on the trial calendar.
