Motor Vehicle Accident
This matter involved a motor vehicle accident in which our client was traveling north on Riverside Drive at or near 158th Street, when his stopped vehicle was rear ended by the defendant driver. Our client moved for and won summary judgment on liability.
Our client did not seek any emergency medical treatment but as a result of the accident sustained a right knee tear of the posterior horn of the lateral meniscus requiring surgical intervention, a left shoulder rotator cuff tear requiring surgical intervention and multilevel herniations and bulges to the cervical spine with radiculopathy.
The matter was mediated by Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorney Michael Fitzpatrick before a private mediator and an offer of $250,000 was ultimately made to settle this matter. However, the matter did not settle at mediation. The matter appeared on the Court's trial calendar and was ultimately settled by Wingate, Russotti, Shapiro, Moses & Halperin, LLP at a pretrial conference for $300,000.
