Shapiro and Eric Horn obtained a $1,350,000 settlement for the plaintiff, a 47-year-old male, who was injured when he tripped and fell due to a defective raised cellar door on a sidewalk adjacent to a commercial premise. The plaintiff underwent a left knee arthroscopic surgery to repair a meniscal tear, a lumbar spine decompressive laminectomy, and bilateral fusion at L5-S1. The defendant’s experts claimed that plaintiff’s injuries were pre-existing and degenerative, however Eric and Cliff settled the case before trial in Queens Supreme Court for $1,350,000.
