Slip and Fall Injury - Premises Accident

Michael Fitzpatrick, an attorney for WRSMH, recently settled the case of a 40 year old Polish immigrant, who slipped and fell down a flight of steps in the building where he lived. The plaintiff's accident followed a day of heavy rainfall. The plaintiff slipped due in part to water accumulation on the steps. The water present on the steps came from rain that entered the building from hallway windows which were routinely left open by the building's superintendent. Further contributing to the plaintiff's accident was the absence of a second handrail on the flight of steps on which he slipped.

Plaintiff sustained a fracture of the tibia and fibula, which required the surgical insertion of a locked rod into his leg. The matter settled at mediation for $175,000.
