Attorney Bill Hepner settled this case for $2.5 million at mediation for our client who was injured at a construction site. Plaintiff was climbing on a slippery metal form when he slipped and fell 10 feet onto a piece of capped rebar below. Bill had to overcome defendants’ allegations that the accident was solely plaintiff’s fault because he had a safety harness and had actually oiled the metal form earlier which caused it to be slippery. Bill established that the harness was an insufficient safety device because plaintiff was required to unclip it to move across the form. Additionally, plaintiff was told to oil the form to make removal of the form easier, so it was not his fault. Plaintiff sustained multiple injuries including a herniated disc in his lumbar spine that required fusion surgery.
