Attorney Erin K. Hurley obtained a $1.75 million settlement, plus a full waiver of the workers' compensation lien, for a Brazilian laborer. The worker was injured when a co-worker on the floor above dropped a 25-pound metal pole through an opening, which struck our client and caused him to fall to the ground. Despite the accident, our client continued to work that day and for two more days before seeking medical attention. He suffered meniscal tears in both knees and a herniated lumbar disc for which he underwent fusion of his sacroiliac joint. Defendants claimed the accident was not reported and that their on-site medic saw no bruising on our client's back when he was examined a few days afterward. Erin countered this argument by establishing that the plaintiff tried to work through the pain and, when he could no longer do it, reported the accident and sought medical attention.
