Carmine Goncalves of Wingate, Russotti, Shapiro Moses & Halperin, obtained a $3,280,000 settlement for a then 35-year-old union construction worker who fell from a straight ladder placed on a recently painted floor.
As a result of the accident, the plaintiff suffered injuries to his knee, shoulder, neck and back; he required a two-level back surgery with hardware placement and three arthroscopic procedures.
Given the clear liability of the defendants in failing to provide plaintiff an adequate safety device, Carmine was able to resolve the matter early in the litigation. The matter settled following multiple conversations between the parties after an earlier unsuccessful private mediation.
