Frank J. Lombardo, attorney with Wingate, Russotti, Shapiro, Moses & Halperin, LLP, settled this matter during discovery. The plaintiff was a 45-year-old non-union laborer at the time of the accident. He was ascending a wooden extension ladder carrying bricks when the ladder collapsed, causing him to fall to the ground.

Frank alleged that the plaintiff sustained a tear of the right knee anterior cruciate ligament and underwent arthroscopic anterior cruciate ligament reconstruction with patella tendon allograft. The defendants contended that the plaintiff did not sustain a tear of the anterior cruciate ligament and the ligament deficiency was a result of a longstanding degenerative condition.
