Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorney Michael Zisser recently settled a Labor Law case in Federal Court for $2,000,000 plus a full waiver of the workers’ compensation lien. His client, a 39-year-old union taper, was injured when he fell 10 feet from a collapsing scaffold while performing work at the LaGuardia Airport project. There were significant issues in the case, including testimony that the client began disassembling the scaffold while standing on it, as well as the fact that the client returned to work for 8 months before receiving any significant medical treatment apart from the hospital on the date of the accident. Michael persuasively argued that his client continued to work through the pain until it got progressively worse to the point he could no longer continue working. Michael was prepared to call co-workers and family members if the case went to trial in order to establish the veracity of these claims. The plaintiff ultimately underwent a cervical fusion surgery and several arthroscopic procedures.
