Injured Jogger

Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorney William Hepner settled the case, during mediation, of a jogger who was struck by a bicyclist in Prospect Park in Brooklyn for $450,000.00. The defendant bicyclist was taking part in an organized bike tour which entered Prospect Park as a part of its route. The plaintiff claimed that the group of bikers inundated the roadway, and one particular biker entered a lane reserved for joggers, striking plaintiff and fracturing his femur, requiring him to have a rod put into his leg.

The firm was able to establish during depositions that the biker was at fault, for failing to stay in the lane designated for her, along with the tour, which did not have proper supervision of the bikers or the bike tour.
