Pedestrian Knocked Down
At a recent mediation, WRSMH Lawyer Michael Fitzpatrick settled a case involving a 53 year old Russian immigrant woman who was struck by defendant's vehicle while crossing Bay Parkway at or near the corner of 67th Street in Brooklyn. The defendant contended that the plaintiff was crossing the street from behind a parked bus and in the middle of the street when she was struck. A non party witness supported the defendant's version. The plaintiff contended that she was in the crosswalk at the time she was struck and did not emerge from behind any parked vehicle.
As a result of the accident, the plaintiff sustained a hip fracture, which was not treated; a torn meniscus, which required arthroscopic surgery; and an epidural steroid injection in her back for lower back pain. The matter settled at mediation for $150,000.00.
