Worker Tripped and Fell at High End Department Store
Plaintiff was an employee at a high end department store when she tripped and fell on a buckled floor during renovations of the store. We commenced an action against the contractor and sub- contractor who then impleaded the owner of the store, which was the plaintiff's employer. The plaintiff suffered a meniscal tear of her knee, as well as multiple cervical herniations requiring numerous trigger and epidural steroid injections.
The plaintiff did not undergo any surgeries but continued treatment with her pain management doctors, orthopedists and neurologists. The matter was on the trial calendar in New York County. WRSMH attorney Michael Fitzpatrick settled this case at a private mediation for $315,000 with a stipulation that the entire $163,000 workers comp lien be waived.
