NY Ladder Accident
Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorney Andrew Wanger secured a $1.5 million settlement with a waiver of a $350,000 workers’ compensation lien for a client who fell from a defective ladder. As a result of the fall, our client sustained a serious cervical spine injury requiring a single-level fusion surgery. Although we established the defendants’ liability, defense counsel mounted an aggressive attack aimed at minimizing our client’s injuries and disputing the circumstances surrounding the incident and its aftermath. However, we effectively rebutted these arguments by showing that despite making a good recovery, our client’s injuries were consistent with the accident and supported by the objective medical proof.
