NY Construction Accident
Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorney Tracy A. Kinneary obtained an $850,000 settlement for a 51-year-old non-union construction worker who injured his right shoulder in a job-site accident requiring arthroscopic surgery. The result was achieved despite several defense arguments, including that the plaintiff continued working for approximately two months before beginning formal medical treatment.
Tracy successfully obtained summary judgment on liability against the premises owner under Labor Law § 240(1), and she was able to resolve the matter at a pre-trial mediation held shortly before jury selection.
