Construction Site Injury - Fall Injury

Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorney, Kenneth Halperin, obtained a settlement prior to trial in the amount of $475,000.00 for a 55 year old man who was injured in an accident on a construction site.

The accident in question occurred at a construction site in Manhattan where a new commercial building was being constructed. Our client was a Local 7 tile settler, and on the day of the accident he was on a six foot high A-frame ladder setting up temporary lighting near the area where he was about to place marble. Suddenly, an unsecured pipe that was protruding through the wall approximately ten feet above his head came loose, swung down, struck him in the head and caused him to fall off the ladder. Our client had previously complained to the general contractor about the pipe which looked unsafe, however, nothing was done to secure it.

As a result of the accident, the plaintiff aggravated a previously diagnosed herniated disc in his lower back. He had to undergo a micro discectomy procedure and was able to return to work soon after the procedure.
