NY Construction Accident
Wingate, Russotti, Shapiro, Moses & Halperin attorney Andrew Wanger secured a $2,200,000 settlement with a waiver of a $300,000 Workers’ Compensation lien on the eve of trial for a construction worker who was injured in a workplace accident. The accident occurred when a defective circular saw cut off his non-dominant pointer finger and struck him in the chest, knocking him to the ground. Plaintiff's finger could not be re-attached. He also required significant medical treatment to address injuries to his neck and back and later underwent surgery for both.
Although liability was heavily contested, the defense had to contend with our comprehensive expert analysis that identified multiple defects in the saw and analyzed how those defects contributed to the accident. The defense also attempted to minimize the extent of our client’s neck and back injuries by claiming they were pre-existing and degenerative in nature.
