Premises Liability Claim

Plaintiff was a 71 year old resident of Illinois visiting her daughter in Brooklyn when she tripped and fell on a raised cellar door while exiting a store causing her to land on her outstretched arm. The cellar door on which she tripped was raised approximately one inch from the surrounding sidewalk. Plaintiff suffered a fractured dislocation of the right humerus, for which she was treated in an emergency room in Brooklyn, and then she underwent follow up treatment in Illinois where she was forced to undergo a hemiarthroplasty of the injured shoulder. The plaintiff lost several months of work and endured nine months of physical therapy. WRSMH attorney, Michael Fitzpatrick settled the matter at mediation for $300,000.00
