New York Construction Accident - Ladder Fall Injury

WRSMH attorney Michel Zisser settled a labor law case for $3.25 million on behalf of our client, a 40-year-old carpenter who was injured after an electrician leaped from a nearby platform and accidentally struck his ladder. This knocked him and the ladder to the ground. Attorney Michael was able to obtain summary judgment pursuant to Labor Law 240(1), despite the defendant's argument that the acts of the electrician jumping constituted an intervening, superseding cause of the accident. Michael countered this argument by establishing that if our client had the proper safety devices, the accident would not have occurred. Though our client attempted to continue working and did not receive any medical treatment for six weeks following the accident, he ultimately underwent several surgeries, including a lumbar fusion. As a result, Michael was able to obtain this large settlement.
