Motor Vehicle Accident
Our client, a 54 year old construction laborer, was involved in a rear end collision when he was stopped and impacted from behind by the defendant's bus which was transporting special needs adults from an outing to a care facility.
We obtained summary judgment on liability. Due to the accident, our client was forced to undergo a shoulder arthroscopic surgery for a partial thickness rotator cuff tear. He also suffered cervical as well as lumbar herniations and radiculopathy. We retained a vocational rehabilitation expert who opined that he suffered both a past and future diminished earning capacity due to this accident. The defendant was in the process of scheduling their vocational rehabilitation evaluation when the matter was settled at mediation by Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorney Michael Fitzpatrick for $400,000.
