Brooklyn Construction Accident

Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorney Tracy A. Kinneary secured a $4.7 million settlement, together with a full waiver of the workers’ compensation lien, for a non-union construction worker who was injured when a steel beam he and his co-workers were manually hoisting between levels fell and struck him at a Brooklyn construction site.

The plaintiff underwent multiple arthroscopic surgeries, as well as a two-level cervical fusion and ACL reconstruction. Tracy obtained summary judgment under Labor Law § 240(1) and resolved the case prior to trial.
