Brooklyn Construction Site Accident

Thomas Brennan secured a jury verdict in Kings County for an injured construction worker on a highly contested damages-only trial. The then 40 year old Brazilian client was injured on a Brooklyn construction site in July of 2019, when a piece of concrete fell into his eye, while he was removing forms. The client then fell from the ladder he was working on to the ground, injuring his neck, back and left shoulder. After extensive conservative treatment failed, including rounds of pain injections, he underwent a one level lumbar fusion and a left shoulder arthroscopic repair.

Following an over 4-week trial, during which the defendants argued that all but the abrasion to the eye was unrelated to the accident, and all other pathology was degenerative in nature, the jury returned a verdict totaling over $2.7 million, including over $2 million for pain and suffering. The defendants argued that a near 4 month delay in treatment to anything other than the eye meant that the client did not sustain those injuries in the subject incident. There was no offer until jury selection began, and the highest offer extended at any point during the trial was $750,000.
