Attorney Tracy Kinneary secured a $3.2 million settlement and full waiver of the workers compensation claim lien for a construction laborer who fell from a fire escape ladder while doing brick pointing work on a building in the Bronx. The client fractured his finger and sustained injuries to his shoulder, neck, and back, requiring surgery. Defendants argued there were several ladders available for our client to use and he should not have been on the fire escape. We were successful in precluding our client’s employer from offering any evidence at trial based upon their failure to provide discovery and settled the matter simultaneous to filing the Note of Issue.
