Injury Requring Surgery and Physical Therapy

WRSMH attorney, Michael Fitzpatrick, secured a settlement of $250,000.00 on behalf of a 43 year old male who was injured when he slipped on the interior steps of his apartment. There was nothing structurally wrong with the steps that caused him to fall, however, the steps did not contain a handrail. Plaintiff’s experts argued the steps required one, and the defendant’s experts argued the steps did not require a handrail. The matter was on the trial calendar but stayed due to extensive motion practice and appellate work resulting from the denial of defendant’s motion to dismiss the matter. The plaintiff suffered a ruptured patella tendon requiring surgery and 3 months of physical therapy.
