Ken Halperin recently obtained a $500,000 settlement for a twenty six (26) year old man who was the front seat passenger of a car that was struck in the rear by a truck while stopped at a red light. The evidence in this case established that the plaintiff’s vehicle was stopped for a red light for several seconds when the defendant’s truck failed to stop in time and struck the rear of their car, pushing the car forward into the intersection. At the close of discovery we obtained summary judgment against the defendant on the issue of liability. A trial was scheduled on the issue of damages only.
Approximately one month prior to trial a mediation was held and the defendants came up with an offer of $400,000. We rejected the offer and approximately one week prior to trial Ken was able to procure a $500,000 settlement.
As a result of the accident, our client sustained a concussion with some ongoing symptoms of post concussion syndrome, a torn meniscus in his knee which required arthroscopic surgery and a herniated disc in his lower back which required epidural injections. The plaintiff had previously injured his back in a fall approximately seven (7) years earlier and this accident aggravated that condition.
