Understanding Lyft's Insurance Policy

All Lyft drivers are required to carry private insurance, and Lyft also provides up to $1 million in coverage that applies under certain circumstances. There are three phases of app engagement that determine available coverage:

  • Phase 1 is when the driver is on the app but has not yet accepted a ride request. During this phase, coverage is limited. Lyft provides contingent liability coverage, which means it only kicks in if the driver's personal insurance doesn't cover an incident. This coverage includes liability limits of $50,000 per person for bodily injury, $100,000 per accident for bodily injury, and $25,000 for property damage. Importantly, Lyft does not provide collision or comprehensive coverage during this phase.
  • Phase 2 begins when a driver accepts a ride request and is on the way to pick up the passenger. The coverage includes up to $1 million in liability insurance, ensuring considerable protection against third-party claims for bodily injury and property damage.
  • Phase 3 begins when a passenger is in the car and continues from pick-up to drop-off. During this phase, the $1 million liability insurance remains in effect, covering third-party bodily injuries and property damage. Uninsured/underinsured motorist coverage is also included, offering protection if another driver causes an accident and lacks sufficient insurance.

What Is My Lyft Accident Case Worth?

Several factors play a role in determining the values of your claim. For example, medical expenses from a Lyft accident can quickly add up. This includes emergency care costs, hospital stays, surgeries, and ongoing treatments like physical therapy. Expenses for medical devices, such as wheelchairs, adjustable beds, and walkers, should also be included in your claim.

If the accident prevents you from working, your claim should cover compensation for the income you've missed. To accurately assess lost wages, your Manhattan car accident lawyer will review pay stubs, employment contracts, tax returns, and other documents that reflect your regular earnings. If your job offers benefits such as bonuses, commissions, or health insurance, these losses can also be included in your claim as well. Prolonged absence from work due to injuries may affect career advancement, which can be factored into the claim. For self-employed individuals, demonstrating lost income might require business records and client invoices.

Of course, property damage is another key component in determining the value of a Lyft accident claim. This includes any damage to your vehicle as well as personal belongings affected during the accident.

The experienced WRSMH litigators cover all the bases. Our process for handling a Lyft includes the following steps:

  1. Arranging your free consultation
  2. Investigating the accident
  3. Sending a demand letter to liable parties
  4. Negotiating a fair settlement
  5. Taking your case to trial if necessary

The Benefits of a Free Consultation

During your free consultation, we’ll assess your case and advise you on the best course of action moving forward. This is a great opportunity to get to know us better and decide if our firm is a good fit for you. We’ll be happy to answer any questions about your case, our previous Lyft accident cases, and our success in similar cases.

We Gather Evidence to Support Your Case

We will collect the necessary information to build a strong case. This includes gathering accident scene photos that capture vehicle damages, road conditions, and other factors contributing to the collision. Our attorneys also interview witnesses to understand how events unfolded. We’ll also review your medical records to assess the full extent of your injuries and recovery costs. Dashcam footage and surveillance video from security cameras are additional sources of important information we collect.

Negotiating Your Injury Settlement

During negotiations, our lawyers push for a settlement that reflects your losses. We understand the tactics employed by insurers to deny claims and minimize your injuries. We counter these efforts by building a strong, evidence-based case that highlights the other party’s negligence.

Preparing for a Possible Trial

We’re always prepared to take your case to trial if that’s what it takes to get the money you need. During the trial, we may call upon specialist witnesses, such as medical professionals or accident reconstruction specialists, to provide testimony that supports your case and demonstrates the full extent of your damages.

Some of Our Auto Accident Case Results

$4.5 Million | Passengers Injured in Rear-End Collision

WRSMH attorney Jay Wechsler recently settled a case for two automobile accident victims for the global sum of $4,500,000. Our clients were passengers in a vehicle that was rear-ended. One client suffered injuries to his back, knee, and shoulder, while the other client suffered injuries to his back and knee. Both clients made excellent recoveries from their surgeries and only required brief stints of post-operative physical therapy. Even though depositions had not yet taken place and discovery had just begun, Jay was able to obtain an excellent result at the early stages of the case. The cases were settled at a private mediation for $4.5 million.

$2.8 Million | Client Struck Twice in Rear-End Collision

The plaintiff was struck twice from behind in a rear-end collision involving two vehicles. The plaintiff sustained serious injuries to his neck, which resulted in nerve damage to both his arms and middle finger on his left hand as well. Our client also suffered from an aggravation of a pre-existing yet asymptomatic degenerative condition in his neck, which made him more susceptible to new injuries. WRSMH attorney was able to settle shortly after our client's testimony, where he was able to show that, despite the extent of our client's pre-existing degenerative spinal condition, our client lived a very productive life, working full-time in a physically demanding occupation without any prior complaints of pain in his neck. Our attorney argued that while our client may have been more susceptible to a serious injury from an otherwise mild accident, the offenders were responsible for any of his medical conditions that developed after, and as a result of, the accident, regardless of his increased susceptibility. The offenders agreed to settle just prior to our attorney putting forth his medical testimony.

What Clients Think of Us

"Really Passionate, Cares Deeply” - Samantha Feliz (5-Star Google Review)

Attorney Steve Wagner achieved a tremendous result for my father. He had a car crash where his car was struck from behind. He sustained serious back injuries, requiring a major back surgery where they put metal in his back. Attorney Ashley Jacoby did a great job working on the case before Steve took the case to trial. To prepare for the trial, Steve spent hours with my dad and our entire family. He even came to the apartment multiple times. Steve selected a jury and then managed to get the entire defense thrown out! The defense had no choice but to settle right before opening statements for more than we had hoped for. Steve worked really, really hard to help us win. But maybe, more importantly, he’s really passionate, and it’s clear he cares deeply about our family and our future.

"Highly Recommend This Firm” - Alex L. (5-Star Yelp Review)

After doing some research, I went with this firm after I read all the overwhelmingly positive testimonials from former clients and a few of the very impressive settlement amounts on their website. I called them to discuss my options following a car accident, and they made the entire process easy. My initial consultation was completely free, and my attorney was attentive and always reachable. The staff was also friendly and very helpful. I truly felt that I was in good hands. I highly recommend this firm to anyone looking for a lawyer for any type of personal injury or medical malpractice case.

"Took My Worries Away” - Positive Mind77 (5-Star Google Review)

I would like to take this time to express my gratitude to my attorney, Victor Goldblum. I am a solo entrepreneur & depend on myself to support my three children. After being struck by a tractor-trailer, I endured spine surgery, shoulder surgery, nerve damage, years of pain injections, & severe back pain, which forced me to depend on others. I was so scared when I was unable to walk & move around like normal. Victor was by my side the whole process & took my worries away, genuinely caring for my well-being and recovery. Trucking companies are the WORST! They don't care whose life they destroy! Victor stayed on top of them & we are finally getting justice.
