New York City personal injury law firm Wingate, Russotti, Shapiro, Moses & Halperin, LLP regularly partners with attorneys who are looking to refer or co-counsel on complex personal injury cases. We focus on serious and catastrophic injury matters, particularly those arising from construction accidents and motor vehicle collisions.

If you are looking for a litigation partner with the experience, resources, and track record to handle high-stakes cases, we welcome the opportunity to work with you.

Why Attorneys Refer Cases to Our Firm

Attorneys refer cases to WRSMH when they want to feel confidence that their client is in capable hands and that a serious case will receive the attention and resources it requires.

Perhaps one of the strongest indications of the professional relationships WRSMH has developed is the range of people who have referred matters to the firm. In addition to referrals from attorneys throughout New York, the firm has received cases from judges and jurors before whom its attorneys have appeared and from lawyers who have litigated against WRSMH attorneys.

Key reasons attorneys choose to work with us include:

  • Proven Results: WRSMH has recovered more than $2 billion for clients and has handled significant personal injury matters involving construction accidents, motor vehicle crashes, catastrophic injuries, medical malpractice, and other forms of negligence.
  • Trial-Ready Approach: Our philosophy is to thoroughly prepare cases for the courtroom, with careful attention to the evidence, applicable law, medical issues, liability, and damages.
  • Resources to Handle Complex Cases: Significant injury cases can require extensive discovery, investigation, depositions, medical analysis, and qualified expert witnesses. WRSMH has the resources necessary to develop complex litigation.
  • Client-Focused Representation: A referral involves more than transferring a case. It involves entrusting another firm with your client relationship. We understand the importance of treating referred clients professionally and keeping communication clear throughout the process.
  • Decades of Personal Injury Experience: The firm has represented injured people in New York for more than 50 years and has extensive experience navigating complicated personal injury litigation.
  • Collaborative Relationships: We recognize the importance of the referring attorney’s relationship with the client and can discuss an appropriate referral or co-counsel structure based on the circumstances.

Types of Cases We Accept Through Referrals

WRSMH primarily focuses on serious and complex personal injury cases. When another attorney refers a case, we can evaluate the circumstances, injuries, liability issues, potential defendants, and other factors to determine whether the matter fits the firm’s practice.

Cases referred to WRSMH may include:

  • Construction Accidents: Serious injuries involving scaffolds, ladders, falls from heights, falling objects, unsafe equipment, and other dangerous construction site conditions.
  • Car Accidents: Motor vehicle collisions resulting in significant injuries, including crashes involving complicated liability or substantial damages.
  • Truck Accidents: Commercial vehicle cases involving truck drivers, trucking companies, vehicle owners, maintenance providers, loading companies, and other potentially responsible parties.
  • Catastrophic Injuries: Claims involving life-changing injuries that may require extensive medical care, rehabilitation, assistance with daily activities, or treatment extending far into the future.
  • Wrongful Death: Cases involving families who have lost loved ones because of negligence and may have grounds to pursue compensation under New York law.
  • Medical Malpractice: Significant medical negligence cases involving severe or catastrophic injuries, including birth injuries, paralysis, coma, and other substantial harm.
  • Premises and Building Accidents: Serious injuries arising from dangerous property conditions, including falls, elevator accidents, and ceiling collapses.
  • Other Serious Personal Injury Cases: Additional negligence claims may be considered based on the circumstances, injuries, potential damages, and applicable law.

If you are unsure whether a case is a good fit, we are happy to discuss it with you.

Flexible Referral & Co-Counsel Arrangements

We understand that every referral relationship is different, and we are flexible in how we work with referring attorneys.

Some referring attorneys would prefer to have WRSMH assume full responsibility for handling the litigation. Others want to remain involved and work with our attorneys as co-counsel. In appropriate circumstances, attorneys may collaborate more closely on case development, litigation strategy, discovery, depositions, settlement negotiations, or trial preparation.

Fee-sharing and referral arrangements must comply with New York ethical requirements. Under Rule 1.5(g) of the New York Rules of Professional Conduct, lawyers from different firms may divide a legal fee if the division reflects the services each lawyer performs or if each lawyer assumes joint responsibility for the matter through a written agreement provided to the client.

The client must agree to the employment of the other lawyer after disclosure of the fee division, including each lawyer’s share, and that agreement must be confirmed in writing. The total fee cannot be excessive.

Our Approach to Partnership

We value long-term relationships with referring attorneys and aim to make the referral process straightforward and transparent. For referring lawyers who wish to remain involved, the specific level of involvement can be established when the referral or co-counsel arrangement is created. Throughout a co-counsel relationship, we recognize the importance of respecting the professional relationship the referring attorney has already established with the client.

The ultimate focus remains on the injured client. Regardless of how attorneys divide responsibilities, decisions concerning the representation must be guided by the client’s interests and comply with applicable professional obligations.
