Car Accident

Our client, a 25 year-old Mexican immigrant, was riding his bicycle the wrong way down a one way street when he was sideswiped by a pick-up truck. As a result of the collision, our client suffered a fractured big toe and knee injuries that ultimately required surgery. Our client returned to work as a bus boy less than 2 months after the accident. The defendant contended that no collision ever occurred. Specifically, he did not stay at the scene of the accident, nor were there any marks on his vehicle indicating a collision occurred.

Wingate, Russotti, Shapiro, Moses & Halperin, LLP was able to locate and obtain a witness statement from someone who heard the collision. Additionally, during the deposition of the defendant, he acknowledged that someone had banged on the window and told him there had just been a collision involving his vehicle. Based on this testimony, the case settled prior to trial for $150,000.
