Douglas A. Milch, of counsel for Wingate, Russotti, Shapiro, Moses & Halperin, LLP, recently obtained a $400,000.00 settlement on behalf of a 58-year-old Westchester County resident who injured her cervical spine in a Somers motor vehicle accident. The settlement was concluded after Douglas was able to obtain summary judgment on liability in favor of our client and establish that the accident had exacerbated her prior cervical condition. This case is a great example of how careful analysis of vehicular damage and biomechanical forces involved in a motor vehicle impact can be used to refute defense claims that the injuries pre-dated the accident, as well as establish the severity of recent injuries superimposed on prior spinal issues at the same cervical level.
