WRSMH obtained a $2,000,00 settlement for a now 71-year-old union taper who was injured while working at a construction site. At the time of the accident the plaintiff was working on a 6-foot Baker Scaffold taping sheetrock that had been installed. An A-frame dolly that had sheetrock stored on it was being moved when it fell over causing the sheetrock to strike the scaffold. As result of the sheetrock coming into contact with the scaffold the scaffold tipped over causing the plaintiff to fall 6 feet to the concrete floor.

As a result of the accident the plaintiff sustained injuries to his right shoulder, neck and lower back. Although the plaintiff had degenerative changes to the injured body parts they had not prevented him from performing his job prior to the accident. As a result of the accident the plaintiff required surgery to his right shoulder, cervical spine and lumbar spine.

During depositions we established that the defendants had violated Labor Law Section 240 in failing to provide the plaintiff with a proper safety device. The case was resolved at mediation for $2,000,000.
