Premises Liability - Trip and Fall Injury
Wingate, Russotti, Shapiro, Moses & Halperin, LLP obtained a $200,000 recovery for our 49 year old client who tripped and fell on a defective, missing portion of the sidewalk in midtown Manhattan. The plaintiff caught her foot in a gap between decorate granite pavers and the concrete sidewalk. The plaintiff suffered a right knee lateral meniscus tear, requiring her to undergo surgical arthroscopic to repair the torn meniscus. The defendants denied having any notice of the defective condition and claimed the plaintiff’s injuries were not causally related to the accident. The firm's efforts in litigating the case resulted in the settlement of this case at mediation for $200,000.
