Premises Liability - Trip and Fall
WRSMH attorney recently obtained a settlement in the amount of $400,000 for an 82-year-old woman who was injured when she tripped and fell on a chipped step inside the defendant’s store. In addition to the step missing an edge, it also lacked handrails and, as result, our client was not able to catch her balance. The firm was successful in arguing at mediation that the missing piece of step and the lack of handrail constituted a hazard to customers, including the plaintiff. As a result of the accident, our client sustained a fractured shoulder and she was required to undergo a shoulder replacement surgery.
