Noah Katz and another Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorney successfully obtained an $850,000 recovery on behalf of his client who tripped and fell over a medical device that was installed into the floor within defendants’ medical facility. During the course of discovery, Noah showed that patients should have been warned of the location of the device, so as to avoid the hazard of tripping over it, and that the device itself could have been positioned so that it was not in close proximity to a patient while present in the room. As a result of the accident, the plaintiff sustained a trimalleolar fracture which required one surgery, and lost earnings were not a factor in the case. The case was located in Richmond County and had not yet reached the trial stage before having settled.
