Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorney Lauren Pennisi obtained a $1.6 million settlement at mediation on behalf of a 37-year-old woman who was struck by a falling tree branch. Liability was contested as defendant disputed that it had notice of the dead and/or decaying tree branch, claiming that the branch was healthy on an inspection conducted 18 months prior to the incident. As a result of the accident, plaintiff sustained injuries to her head, thoracic spine and neck, and required a cervical instrumentation and fusion surgery at C5-6.
