Douglas Milch, of counsel for Wingate, Russotti, Shapiro, Moses & Halperin, LLP, recently obtained a $950,000 settlement on behalf of Queens resident whose car was struck by a tractor-trailer. The plaintiff’s car was damaged upon impact, and he sustained a herniated disc at L5/S1.
When extensive physical therapy and spinal injections failed to alleviate his spinal pain, the plaintiff was forced to undergo a lumbar disc decompression/discectomy.
The defendants maintained that they were not the cause of the accident. However, at deposition, Doug was able to establish that the defendant driver improperly attempted to make a right turn from the left lane when he struck the plaintiff’s vehicle. In addition, over the course of two years, Doug was able to demonstrate to the court that the defendants had failed to turn over their own records of the accident, resulting in an order precluding them from offering this evidence at trial.
