Pedestrian Knockdown Car Accident

After jury selection, Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorney, Jason Rubin settled a pedestrian knockdown automobile accident case for $225,000.00. Plaintiff, then 59 years old, was walking in a crosswalk at the intersection of West Avenue and Ocean Parkway in Brooklyn when he was struck by a yellow cab. As a result, plaintiff sustained a fracture of the mastoid and a slight brain hemorrhage. He was required to remain in the hospital for one week and was transferred to a nursing home for rehabilitation for one month. At the time of the accident, plaintiff was on disability because of two prior head injuries.

This settlement was noteworthy because $125,000.00 of the settlement was paid by the cab company itself, over and above the $100,000.00 insurance maintained on the cab.
